UNLAWFUL RETLIATION: THE PRIMA FACIE CASE: PROTECTED ACTIVITY<\/h3>\r\n\"To establish a prima facie case of retaliation, an employee must show three things: (1) the employee took a statutorily protected action<\/em> [(i.e., protected activity<\/em>)], (2) the employee suffered an adverse employment action, and (3) a causal link between the employee's protected activity and the adverse employment action.\" Id.<\/em> at 234 (citing Currier v. Northland Servs., Inc.<\/em>, 182 Wn.App. 733, 742, 332 P.3d 1006 (2014); see also Wilmot v. Kaiser Alum. & Chem. Corp<\/em>, 118 Wn.2d 46, 68, 821 P.2d 18 (1991) (\"establishing the retaliation test in the worker's compensation context\")) (emphasis added).\r\n

UNLAWFUL RETALIATION (WA STATE): GENERALLY<\/h3>\r\nThe Washington Law Against Discrimination proscribes discrimination in employment and includes a section regarding unlawful retaliation by employers.\r\n\r\nThe law is codified under the Revised Code of Washington (RCW).\u00a0The relevant unlawful retaliation section states as follows:\r\n
Unfair practices\u2014Discrimination against person opposing unfair practice\u2014Retaliation against whistleblower.<\/h5>\r\n

(1)<\/strong> It is an unfair practice for any employer, employment agency, labor union, or other person to discharge, expel, or otherwise discriminate against any person because he or she has opposed any practices forbidden by this chapter, or because he or she has filed a charge, testified, or assisted in any proceeding under this chapter.<\/p>\r\n

(2)<\/strong> It is an unfair practice for a government agency or government manager or supervisor to retaliate against a whistleblower as defined in chapter 42.40<\/a> RCW.<\/p>\r\n

(3)<\/strong> It is an unfair practice for any employer, employment agency, labor union, government agency, government manager, or government supervisor to discharge, expel, discriminate, or otherwise retaliate against an individual assisting with an office of fraud and accountability investigation under RCW 74.04.012<\/a>, unless the individual has willfully disregarded the truth in providing information to the office.<\/p>\r\nRCW 49.60.210<\/a>.\r\n
