Please review our <a style=\"color: #ff0000\" href=\"https:\/\/gwilliamslaw.com\/court-slips\/disclaimer-privacy-policy\/\" target=\"_blank\" rel=\"noopener\">Disclaimer \/ Terms of Use \/ Privacy Policy<\/a> before proceeding.\u00a0<\/span><\/em><\/p>\r\n\r\n<h3>WASHINGTON LAW AGAINST DISCRIMINATION: PROTECTED CLASSIFICATIONS<\/h3>\r\nUnder WLAD, it is an unfair practice, with very few exceptions, for an employer to refuse to hire any person, to discharge or bar any person from employment, or to discriminate against any person in compensation or in other terms and conditions of employment because of the following protected classifications:\r\n<p style=\"padding-left: 40px\">1.\u00a0 Age (40+);<\/p>\r\n<p style=\"padding-left: 40px\">2.\u00a0 Sex (including Pregnancy);<\/p>\r\n<p style=\"padding-left: 40px\">3.\u00a0 Marital Status;<\/p>\r\n<p style=\"padding-left: 40px\">4.\u00a0 Sexual Orientation (including Gender Identity);<\/p>\r\n<p style=\"padding-left: 40px\">5.\u00a0 Race or Color;<\/p>\r\n<p style=\"padding-left: 40px\">6.\u00a0 Creed;<\/p>\r\n<p style=\"padding-left: 40px\">7.\u00a0 National Origin;<\/p>\r\n<p style=\"padding-left: 40px\">8.\u00a0 Honorably Discharged Veteran or Military Status;<\/p>\r\n<p style=\"padding-left: 40px\">9.\u00a0 HIV\/AIDS and Hepatitis C Status;<\/p>\r\n<p style=\"padding-left: 40px\">10 The presence of any sensory, mental, or physical disability or the use of a trained dog guide or service animal by a person with a disability; and<\/p>\r\n<p style=\"padding-left: 40px\">11.\u00a0 State Employee or Health care Whistleblower Status.<\/p>\r\nIt is also an unfair practice for an employer to retaliate (i.e., discharge, expel, or otherwise discriminate) against a person because the person complained about any practices forbidden by the WLAD, or because the person has filed a charge, testified, or assisted in any proceeding under WLAD.\r\n<h3>THE PRIMA FACIE CASE<\/h3>\r\nGenerally, to establish a prima facie claim of hostile work environment against an employer, the employee must produce competent evidence of each of the following four elements:\r\n<p style=\"padding-left: 40px\">(1) that the harassment was offensive and unwelcome;<\/p>\r\n<p style=\"padding-left: 40px\">(2) that it occurred because of the employee\u2019s membership in a protected class;<\/p>\r\n<p style=\"padding-left: 40px\">(3) that it affected the terms and conditions of employment\/membership; and<\/p>\r\n<p style=\"padding-left: 40px\">(4) that the harassment can be imputed to the employer.<\/p>\r\n<em>See, e.g., <a href=\"https:\/\/gwilliamslaw.com\/wa-employment-law-digest\/glasgow-v-georgia-pacific-corp\/\" target=\"_blank\" rel=\"noopener\">Glasgow v.
